This appeal is from an order granting the motion for summary judgment raised by appellee AT&T Technologies and appellee Western Electric Company, Inc.. On appeal, appellant Harold Lorah claims that the lower court erred in determining that as a matter of law the Peculiar Risk Doctrine, an exception to the general rule that an employer of an independent contractor is not liable for the physical harm due to the negligence of the contractor or his servants, is not applicable. He claims that our prior precedent militates that we impose vicarious liability on the appellees for the negligence of their independent contractor and/or his servants. After reviewing the relevant case law and the parties briefs, we find that the lower court appropriately granted summary judgment in this case. We affirm.
