Automobile accident. Plaintiff Nothem was injured in a head-on collision between the automobile in which he was riding, driven
by defendant Berenschot, and another car driven by defendant Schmechel. The jury found that Berenschot was causally negligent
with respect to operating his car on the wrong side of the highway, and that Schmechel was not negligent in that respect.
Judgment was entered on the verdict, in favor of plaintiff against Berenschot 1 for damages and costs, and dismissing the
complaint and Berenschot's cross-complaint as against Schmechel, with costs to Schmechel. Berenschot appealed. Sometime after entry of judgment an order was entered ex parte on Berenschot's application, extending the time for serving
the bill of exceptions. Plaintiff appealed from that order, and later moved this court to strike the bill of exceptions because
not timely served.
