[Professor Harold Luntz came to the Melbourne Law School from South Africa in 1965. His recent retirement affords the opportunity to survey the changes that have occurred during his service to the law of torts and to damages for personal injury. The author, by reference to Harold Luntz's writings, reviews the emergence of a distinctive Australian body of law, freed from the controls of English law. The outcome, however, is not always clear. For example, Australia has resisted Professor Luntz's call to embrace the New Zealand accident compensation system as a more just and cost-effective way to deliver compensation. In the context of current national and state moves to introduce special legislation with caps and limitations, the author suggests that a struggle is under way for the future of the law of torts.
